The U.S. Supreme Court upholds the Biden administration’s regulation on “ghost guns,” ruling by a 7-2 majority that these kits fall under federal definitions of firearms. This landmark decision addresses the surge in ghost gun crimes, with law enforcement seizing over 19,000 untraceable weapons in 2021 alone, marking a tenfold increase in just five years.

Justice Neil Gorsuch, writing for the majority, confirms the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) can regulate the sale of unfinished firearm components, ensuring they meet the same standards as commercially sold firearms. The ruling’s implications emphasize the need for background checks and serial numbers, as ghost guns can often be easily assembled from readily available parts, raising significant public safety concerns.
