The Kansas Supreme Court affirms a lower court’s decision to dismiss a product liability lawsuit against Beretta and Bass Pro Shops, following a mishandling incident that left a former Emporia State University football player severely injured. Andre Lewis was shot by teammate Marquise Johnson, who mistakenly believed he needed to pull the trigger to disassemble the gun, leading to Johnson’s leg amputation after he was struck by a bullet in the incident.

This ruling reinforces the provisions of the Protection of Lawful Commerce in Arms Act, which grants immunity to firearms manufacturers and sellers when guns are used unlawfully. Justice K.J. Wall emphasized that despite arguments regarding Lewis’ mental state, the law protected the companies involved, highlighting the complexities of liability in firearm-related injuries. The decision underscores ongoing debates about gun safety and responsibility amid rising concerns about preventable shootings.
