Buc-ee’s, the renowned Texas gas station chain, has filed a federal lawsuit against South Carolina apparel company Born United for allegedly infringing on its trademarked beaver logo. The lawsuit claims that Born United is selling clothing items, including T-shirts and patches, that feature the Buc-ee’s beaver depicted in military gear and armed with a gun, which Buc-ee’s argues is not only a trademark violation but also an infringement that continued despite a cease-and-desist order.

Born United operates under the slogan “Bringing brands together that stand for freedom,” and the lawsuit highlights the irony in their use of the Buc-ee’s logo. As Buc-ee’s seeks to halt the sale of these products and claims damages, Born United has expressed a willingness to engage in dialogue. This case raises important questions about trademark rights in the apparel industry and the implications of using familiar logos in new contexts.
