In a significant development in the fight against gun violence, Minnesota law enforcement increasingly relies on the Extreme Risk Protection Order Act, commonly known as the ‘Red Flag’ law, to prevent individuals deemed a threat from accessing firearms. In just the first seven months of 2025, officials filed more emergency petitions to restrict gun access than in all of 2024, with the courts approving 82% of these requests, suggesting a pronounced shift in how police approach potential threats.

This trend follows a troubling rise in gun deaths in Minnesota, which saw a 6% increase in 2024. Law enforcement agencies, particularly in Hennepin County, are adapting to this legal tool, with specialized training to ensure proper use of the emergency petitions. However, concerns remain regarding the law’s impact on due process, as critics argue it often prioritizes police intervention over individual rights.
