Montana is spearheading a coalition of 27 states petitioning the U.S. Supreme Court to review and potentially overturn a Washington state law that restricts the sale and possession of firearm magazines capable of holding more than 10 rounds. The coalition, led by Montana Attorney General Austin Knudsen, argues that the Washington Supreme Court’s decision upholding the ban contradicts Second Amendment rights, as nearly half of all gun owners in the U.S. possess such magazines, totaling an estimated 542 million in circulation.

In a filed amicus brief for the case Gator’s Custom Guns, Inc. v. State of Washington, the attorneys general assert that the Washington law infringes on a well-established constitutional right. Knudsen emphasized that law-abiding citizens should not face criminal penalties for exercising their rights to self-defense, a sentiment echoed by other participating states, including Louisiana and Idaho, which also are pushing back against what they consider a violation of Second Amendment protections.
