The Montana Legislature has passed House Bill 809, preventing local governments from implementing red flag laws, which aim to temporarily remove firearms from individuals deemed a danger to themselves or others. The bill, backed by Rep. Braxton Mitchell, R-Columbia Falls, received a vote of 29 to 19 in the Senate and now awaits the governor’s approval.
Red flag laws can allow law enforcement to act swiftly to prevent potential harm, particularly in situations involving domestic violence and suicides. However, advocates of HB 809 assert that such laws infringe on Second Amendment rights. Currently, Montana does not have any red flag laws, following the tabling of a 2023 proposal intended to establish one in the state.
